Can a landlord or property manager advertise a rental unit as safer, healthier or protected because it uses a NanoFlashing™ filter?
The company gives no permission for that claim: its Terms of Use state that Site Content is not permission to make a product claim.
The Terms of Use state: “Site Content is not a product specification, design file, manufacturing instruction, validation report, certificate, patent license, technology license, or permission to make a product claim.” They also state: “A laboratory reduction in a virus, bacterium, fungus, particle, or other endpoint does not establish a clinical benefit, fewer infections, disease prevention or treatment, or improved health.” Among prohibited uses they list: “State or imply that C-POLAR has approved, endorsed, licensed, partnered with, or verified you, your organization, or your product, when it has not.” The NanoFlashing™ Air Filter label states: “It works alongside ventilation and cleaning, not in place of them.” A question about advertising wording can be sent to [email protected].
