Who carries the risk if the shipment is damaged in transit?
The Terms of Use state that the Site is informational only, that it does not sell products, accept orders, quote binding prices, or process payments, and that these Terms do not govern the sale, delivery, installation, return, warranty, or use of a finished product.
When risk passes from the seller to the buyer is a term of that sale, and it is usually stated as a delivery term on the order. The Terms of Use state: “Nothing in this section removes a right that the law gives you.”
The terms that govern an order are the terms the seller presented, and a question about them goes to that seller. The manufacturing and distribution partners the company names on its About and Air pages are Aero Pro, AQ Filter, BGE Indoor Air Quality Solutions, Olympic International and VOLZ Filters, and the two products it names are INHALO™ and ReinFire™. The Terms of Use also name two online stores, shop.cpolartechnologies.com and shopusa.cpolartechnologies.com; those two stores are C-POLAR's own, and a price shown there and every purchase from them are governed only by the terms presented there. NanoFlashing™ is a technology; the name, rating and sale of a product that carries it are set by that product's maker and seller.
