What would an ordinary buyer understand permanent to mean about performance, maintenance and replacement, and what supports that understanding?

Permanent describes the property of the material, and it is not a service life for a finished product.

NanoFlashing™ is a permanent positive polarity engineered into filter media itself. It is a physical property of the filter. The polarity is a positive electric charge at rest. The charge is measured on every production run, and the measurement can be repeated on any filter, upon request. The NanoFlashing™ page states: “Conventional electrostatic charges fade in service, dragging performance down with them.” It also states: “NanoFlashing™ does not fade.” The Validation page states: “Industry standards ASHRAE 52.2 Appendix J and ISO 16890 test electrostatic filters after their temporary charge is removed, showing how they perform without it.” It also states: “NanoFlashing™ maintains MERV 15A performance under ASHRAE testing”, and its pathogen section lists, among the conditions tested, “Used filter for 1 year”, “After 2 years of storage” and “After 60C for 64 days”. The Terms of Use state that, as of their effective date, the Water, Textiles, Food packaging, and Medical devices chapters describe Research Applications, and that they do not describe finished products currently available from C-POLAR for those uses.

The filter has service limits, and they are printed on it. The label states when to replace it: at the pressure drop or the replacement interval printed on it, whichever comes first. The label also instructs: “Do not wash, vacuum, brush, blow out or reuse this filter.” The label states: “Results in a building depend on the system, the airflow, and how well the filter fits its track.” NanoFlashing™ is a technology; the name, rating and sale of a product that carries it are set by that product's maker and seller.
