Does a supplier's financial distress trigger an early-warning process?

C-POLAR publishes no early-warning process for a supplier in financial distress.

Continuity of supply is a matter for the agreement between the parties to it, and C-POLAR publishes no continuity plan.

C-POLAR markets a materials technology. Every commercial NanoFlashing™ product is made by a manufacturing partner, in their facility, in their format. The Terms of Use state: “Accessing the Site or contacting C-POLAR through the Site does not create a partnership, agency, joint venture, distribution right, supply commitment, license, exclusive right, or other business relationship.” The Terms of Use define a Separate Agreement as a written agreement signed by an authorized C-POLAR officer, and state that a prospective partner may rely only on a commitment stated in a Separate Agreement.

Terms of that kind are agreed in writing between the parties to a supply agreement.
