Permission for a finished product is obtained by the party placing it on that market. Every commercial NanoFlashing™ product is made by a manufacturing partner, in their facility, in their format. For the United States, the Statement of Classification concludes at 3.7 that the company classifies the NanoFlashing™ Air Filter as a device under Section 2(h) of FIFRA, 7 U.S.C. § 136(h), and 40 C.F.R. § 152.500(a). For the European Union, the Statement of Regulatory Status concludes at 3.7 that the company classifies the NanoFlashing™ Air Filter as neither a biocidal product nor a treated article.
